Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Kratys (the "Service"), a production-readiness and deployment platform for applications built with AI code generators. By creating an account or using the Service, you agree to these Terms.

1. The Service

Kratys helps you assess, deploy, and monitor AI-built applications. Kratys operates a "bring your own server" (BYOS) model: you connect your own cloud provider account (currently DigitalOcean), and Kratys provisions and manages infrastructure on that account on your behalf. You pay your cloud provider directly for the underlying servers and resources; those charges are separate from any Kratys subscription fee.

2. Accounts

You must provide accurate account information and are responsible for activity under your account. Authentication is handled through our identity provider. You are responsible for keeping your credentials secure and for any cloud or third-party credentials you connect to the Service.

3. Subscription and Billing

During the early access period, the Kratys platform is free to use. No credit card is required and there is no time limit. When paid billing launches, subscriptions are processed by our payment provider, LemonSqueezy, which acts as the merchant of record.

The standard subscription price is $29/month. Users who join during the early access period lock in $29/month for the life of their active subscription. Subscriptions renew automatically until cancelled. Cloud server costs are billed by your cloud provider and are not part of the Kratys subscription.

4. Cancellation

You may cancel your subscription at any time through your billing settings. Cancellation stops future renewals. Because the Service runs on infrastructure in your own cloud account, you retain control of your servers and code; you are responsible for managing or removing those resources with your cloud provider after cancellation.

5. Your Code and Servers

You retain full ownership of your code, applications, data, and cloud servers. Kratys does not claim ownership of your content. To provide the Service, you grant Kratys permission to access connected GitHub repositories and cloud provider credentials solely to perform the functions you request, such as scanning, building, deploying, and monitoring your applications.

6. Acceptable Use

You agree not to use the Service to:

  • deploy or distribute malware, or violate any applicable law;
  • infringe the intellectual property or privacy rights of others;
  • attempt to gain unauthorized access to the Service, other users' data, or systems not belonging to you;
  • interfere with or disrupt the integrity or performance of the Service or its infrastructure.

We may suspend or terminate accounts that violate these Terms.

7. Third-Party Services

The Service integrates with third parties including your cloud provider, GitHub, our identity and payment providers, and AI model providers. Your use of those services is subject to their respective terms. Kratys is not responsible for third-party services it does not control.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Kratys does not warrant that the Service will be uninterrupted, error-free, or that security scans will identify every issue.

9. Limitation of Liability

To the maximum extent permitted by law, Kratys and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service. To the extent liability cannot be excluded, our total liability is limited to the amount you paid to Kratys in the twelve months preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of [JURISDICTION], without regard to its conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in [JURISDICTION].
